The formal planning process

Once the Preliminary Work is complete and a draft Local Planning Scheme has been prepared, the project enters the statutory process.

Unlike the Preliminary Work, this stage is required under the Planning and Development Act 2005 and follows a formal process set out in the Planning and Development (Local Planning Schemes) Regulations 2015.

The Statutory Process includes review by the Western Australian Planning Commission (WAPC) and Minister for Planning, formal public advertising, consideration of community submissions and a final decision by the Minister for Planning before a new Local Planning Scheme can come into effect.

The timeline below outlines the key steps involved in the statutory process and what the community can expect at each stage.

Statutory approval process

The Statutory Process will begin once a draft Local Planning Scheme has been prepared and considered by Council.

    The Minister for Planning considers the draft scheme and determines whether it may proceed to formal public advertising.

    Statutory public advertising

    The community is invited to review the draft Local Planning Scheme and provide formal submissions during the statutory advertising period.

    Review of submissions

    The City reviews and analyses all submissions received during the public advertising period.

    Council considers submissions

    Council considers the submissions and determines whether any changes should be made before forwarding its recommendation to the WAPC.
