Supporting clear, practical and contemporary fencing requirements

The Fencing Local Law 2025 supports the regulation and management of fencing standards throughout the City of Melville. It operates alongside the City’s local planning framework and outlines requirements relating to sufficient fencing, sightline areas and associated approvals to help support safety, amenity and consistency across the district. The Fencing Local Law 2025 was gazetted on 25 July 2025 and came into effect on 8 August 2025.

Following gazettal, the Joint Standing Committee on Delegated Legislation (JSCDL) reviewed the Local Law and raised matters requiring amendment to ensure compliance with legislative requirements.

At their November 2025 Ordinary Meeting, the Council resolved to undertake amendments to the Local Law within 12 months. The City has prepared the proposed City of Melville Fencing Amendment Local Law 2026 to address these matters. At the April 2026 Ordinary Meeting of Council, Council resolved to endorse the proposal for public advertising.

The purpose of the City of Melville Fencing Amendment Local Law 2026 is to amend the City of Melville Fencing Local Law 2025.

The effect of the City of Melville Fencing Amendment Local Law 2026 is to provide clarity to the public on the requirements for “sight triangles” under subclause 3.1(2) and to ensure that the City of Melville Fencing Local Law 2025 is compliant with the requirements of the Joint Standing Committee on Delegated Legislation.

In accordance with section 3.12(3)(a) of the Local Government Act 1995, the City is inviting public submissions on the proposed amendment.

Submissions must relate to the proposed amendments only and not the entirety of the Fencing Local Law 2025.
